Not sure if it’s illegal for an NRI to have an Aadhaar card? You’re not alone. This quick guide clears the confusion and helps you understand who can apply, who can’t, and what to do if you already have one.

What the law says

The Unique Identification Authority of India (UIDAI) rules state that Aadhaar is only for “resident Indians” — a person residing in India for 182 days or more in the preceding 12 months.

So, for NRIs (Non-Resident Indians) who live outside India, obtaining Aadhaar is not considered valid and if someone submits as resident while not truly so, it may amount to a “false entry”.

Quick checklist for NRIs

If you are an NRI, here’s what to keep in mind:

  • Confirm your residence status: have you been in India for 182+ days?

  • If yes, you may be eligible; if no, avoid applying.

  • Do not use Aadhaar as proof of NRI status abroad.

  • If you already hold one and are no longer resident, consider rectifying status.

  • Keep records of your stay in India to prove residency if needed.

Example scenario

Here’s a practical example: Raj lives in UAE for most of the year and visits India for 3–4 weeks at a time. He has an Aadhaar card from a past visit. Now his bank in India asks for an Aadhaar update. Because he does not meet the 182 day rule, his Aadhaar is technically not valid for linking. He contacts the bank and explains his NRI status and asks what alternate ID he can use.

What happens if you hold one incorrectly

In short — while it isn’t a criminal offence to have an Aadhaar card, using it when you’re ineligible (for example for banking or benefits) could lead to denial of service or legal confusion. The UIDAI has warned that false declaration is not acceptable. Quick tip: If you’re unsure of your status, treat Aadhaar as optional and use alternative documents for NRI services.
